King's Hawaiian and Aldi Settle Packaging Lawsuit

King's Hawaiian has settled a lawsuit against Aldi over packaging sold at the discount grocery chain. King's Hawaiian accused Aldi of infringing on its intellectual property rights for the packaging trade dress it uses for its Hawaiian sweet dinner rolls. Aldi will now change the packaging of its product, a Hawaiian bread stuffing.  

The lawsuit also alleged breach of the parties' earlier settlement agreement that resolved a similar lawsuit King's Hawaiian filed against Aldi in Georgia in October 2015. A settlement in that suit was reached in 2016.

While terms of the settlement agreement are confidential, King's Hawaiian says it's pleased with the settlement and with the resolution of the lawsuit, adding that its packaging trade dress is one of the company's most valuable assets. King's Hawaiian has filed and favorably resolved several similar lawsuits in recent years in federal district courts across the U.S., including in California, Georgia, and Illinois.
