Jamba Juice Sued for False Advertising of Ingredients

Jamba Juice is facing a federal class action lawsuit that alleges the company engaged in deceptive marketing because its beverages are described as "whole fruit and vegetable smoothies" when they often include sugary concentrates. The Center for Science in the Public Interest filed the lawsuit on behalf of a proposed class of New York and California consumers, claiming that the company violated states' consumer protection laws by marketing its juices as containing "whole" and "real" ingredients when they used ingredients like pear and white grape juice from concentrate.

CSPI takes the example of Jamba Juice's Caribbean Passion smoothie, which contains five whole-fruit ingredients: mango, strawberry, peach, orange, and passion fruit. CSPI argues the smoothie appears to have no whole mango, no whole orange, and no whole passion fruit. In addition, the lawsuit takes issue with Jamba Juice's "prominent mention" of "super ingredients," like kale, when other ingredients predominate.

The complaint also alleges Jamba Juice falsely gives consumers the impression that the only sugars in its smoothies are exclusively from whole fruits and vegetables and that the smoothies contain no additives. CSPI cites the example of the Banana Berry smoothie, arguing it has more sugar and corn syrup than raspberries and contains additives such as mono- and diglycerides, locust bean gum, guar gum, and caramel color, among other ingredients.
