U.S. District Judge Richard Seeborg has ruled that California cannot prohibit Miyoko’s Kitchen from using the terms “butter,” “lactose-free,” and “cruelty-free,” on its packaging. Miyoko’s sued the California Department of Food and Agriculture in February after it told the company to stop using the terms to avoid consumer confusion.
“The state’s showing of broad marketplace confusion around plant-based dairy alternatives is empirically underwhelming,” Seeborg said in the ruling.
However, Miyoko’s cannot use the terms “hormone-free,” and “revolutionizing dairy with plants,” as Seeborg believe they are “plainly misleading.”
