The FTC has filed an administrative complaint challenging Post Holdings, Inc.’s proposed acquisition of the private label ready-to-eat cereal business of TreeHouse Foods, Inc. According to the FTC, Post and TreeHouse are two of only three significant manufacturers and distributors of ready-to-eat cereal in the U.S., and if the $110 million acquisition goes through, it would give Post more than a 60 percent share of an already highly concentrated market and remove the competitive pressure that drives higher quality and lower priced cereals for U.S. consumers.
This complaint marks the beginning of proceedings in which the allegations will be tried in a formal hearing before an administrative law judge. The trial is scheduled to begin on May 27. 2020.
