A federal judge has denied St. Louis-based Billy Goat Chip Co.'s motion to dismiss a trademark infringement lawsuit filed by Billy Goat Tavern, reports the Chicago Tribune. The lawsuit argues that the Chicago chain already sells Billy Goat-branded frozen burgers and beer in Chicago-area grocery stores, and intends to start selling potato chips in stores as well.
In court filings, the chip company argues that the tavern waited nearly a decade to file the suit after becoming aware of the Billy Goat Chip Co. trademark. As an example, the defendant mentions in the court filing that Billy Goat Chips have been sold at Eataly since 2014. In the Chicago area, Billy Goat Chips are also sold at six Whole Foods Market stores, four Binny's Beverage Depot stores, and the French Market at Ogilvie Transportation Center, according to the Billy Goat Chip Co.'s court filings, according to the report.
